CRESTAR COMMUNICATIONS ACCEPTABLE USE POLICY
In order for Crestar Communications to better serve you, the customer, we have compiled
a set of guidelines known as the "Acceptable Use Policy." This policy applies to all
customers equally and covers topics such as account usage, e-mail, news, and chat
abuse.
We reserve the right to add, remove, or alter the policies on this list without
notification. Therefore we ask that you keep yourself up to date with our policy.

Account Usage
Crestar Communications offers accounts with "unlimited
access." Although access is unlimited, some restrictions
apply.
- Accounts which are idle for 45 minutes will be disconnected
by the server. The term idle is defined as a lack of traffic being
passed over the connection. For example, if you are connected, but
working off-line with a word processor for more than 45 minutes, your
connection will be dropped. The same applies for mail clients which
allow one to compose mail off-line, as well as other off-line activities.
- Definition of "Unlimited use". Crestar Communications
defines "unlimited use" as "reasonable attended use" of our dialup Internet
access services. Our dialup accounts are not leased-line or dedicated-line accounts.
Users who average more than 8-10 hours of continuous use per day, or those leaving
their systems online and unattended to check mail, will be asked to curb their usage
habits or upgrade to a dedicated-line connection. It is the customer's responsibility
to make sure that this policy is observed.
- 24 Hour sessions may be grounds for immediate termination of
service.
- Single User Accounts. All Dialup accounts are single customer accounts.
With the exception of people who have ordered extra e-mail boxes, these accounts
should be used by the owner of the account only, and there should only be one
concurrent login session at any time. Failure to comply with this regulation is in
direct conflict with the Terms & Conditions which the customer has read and agreed to.
Net Etiquette and Abuse
At Crestar Communications, we would like every person to have the best Internet
experience possible; however, we do not wish it to be at other customers' expense. The
Internet is a global computer network which is comprised of people from diverse backgrounds.
When communicating with people on the Internet, it is best to keep in mind that there is
another person on the other end of the computer that you are communicating with. Please
treat others with the same respect as you would like to be treated.
Following is a set of general guidelines regarding the three most common forms of
Internet communication: e-mail, USENet, and Internet Relay Chat.
Electronic Mail (E-mail)
- Unless you are using an encryption device (hardware or software), you should assume
that any e-mail on the Internet is NOT SECURE. Never put in an e-mail message anything
you would not put on a postcard (such as your password).
- Respect the copyright on material that you reproduce. Crestar Communications
does not review the information flowing through or stored on our system. When you become
a Crestar Communications customer, you are agreeing not to transfer or store
copyrighted works on our system without the express written consent of the copyright
holder.
- Never send chain letters via electronic mail. Chain letters are illegal on the
Internet just as they are through postal mail. If you are found to be sending chain
letters, your account status will come under consideration.
- The cost of delivering an e-mail message is, on the average, paid about equally by
the sender and the recipient (or their organizations). This is unlike other media such
as postal mail, telephone, TV, or radio. Sending someone mail may also cost them in other
specific ways like network bandwidth, disk space or CPU usage. This is a fundamental
economic reason why unsolicited e-mail advertising is unwelcome (and is forbidden in many
contexts).
- Repeatedly sending anyone e-mail with the intent to harass or harm their account
(i.e., "spam" or "mail bombing") is strictly forbidden. Participating in such may be
grounds for account termination.
USENET News
- Content. The content of USENET newsgroups is not regulated by Crestar
Communications; therefore, we are not liable for and take no responsibility fo their
contents. Please do not contact the administrators regarding copyright issues,
inflamatory posts, etc.
- Commercial Posts. Commercial posts are frowned upon in many newsgroups.
If you are attempting to sell goods or services, please make sure you do so in the
proper forums (*.forsale, business groups, etc.).
- Chain Letters/Pyramid Schemes. According to United States law, chain letters
and pyramid schemes are illegal. If you are found to be posting these to news or sending
them via e-mail, your account will be terminated. To read more about chain letters, you
can view a U.S. Postal Service document about them.
- Sending mass posts to multiple newsgroups, known as "spamming" is strictly
forbidden.
Internet Relay Chat (IRC)
Internet Relay Chat is a global network of chat servers which offers people on the
Internet the ability to converse in real-time, text based, chat. IRC is often viewed as
a chaotic network which is controlled by the IRC Server Administrators, Server Operators,
and Channel Operators. Server administrators and operators are appointed by the people who
run the servers, and channel operators are the people who create the channel or any others
who they appoint.
Due to the open nature of IRC, it is not possible for Crestar Communications to
monitor the content of speech. Be advised that much like USENET, you will encounter a
diverse group of people from around the world on IRC; expect to be exposed to material
which you may find offensive.

Terms & Conditions
Privacy and Security
Computer security and privacy are complex issues. It is important to
understand these points:
- We will cooperate with law enforcement officials and with other system
administrators in the legitimate investigation of suspicious activity.
Intentional violations of the privacy of other users, whether on our
system or at another site, will be grounds for immediate termination of
your account and may lead to criminal prosecution or civil penalties.
- We will not intentionally disclose the contents of private files without
the user's permission or a court order.
- Remember that there are unscrupulous people out there who know how to
circumvent system security. Guard your password carefully, move private
and important files to your own system if possible, and do not send by
electronic mail or keep on-line anything you would not want read by your
mother or your boss. Your password is the ultimate key to all of the
information in your account, including your mail, your files, and your
service level information.
Copyright Infringement And Hacking
You are responsible for determining the legal status of any intellectual
property you use or duplicate through our system. Some of the material
available on the network is copyrighted, and some of it may have been
distributed in violation of copyright laws. We cannot and do not review
the information flowing through or stored on our system. You agree not to
violate copyright laws by transferring copyrighted works through our
system or by causing them to be transferred or stored without the
permission of the copyright holder. Breaking this agreement will be
grounds for account termination.
We consider the exchange of information about security mechanisms to be
protected speech. However, traffic in access codes, credit card numbers,
or similar information is a crime that we take seriously. We expect you
to respect the rights and privacy of all users and to use your account
only for lawful purposes.
Controversial and Explicit Material
Because your electronic communications are private, we cannot be
responsible for their contents. The Internet and USEnet are large
communities that regard censorship as worse than obscenity. Through our
service, you will have access to and you will at some time or another
become exposed to materials that you find offensive. Such materials
include sexually explicit text and (encoded) images, pro-religious and
anti-religious debate, questionable political views, and hateful speech.
Crestar Communications expressly disclaims liability for any harm
resulting from encountering such material.
Age Issues
Due to the adult nature of some of the materials available on the Internet,
all minors MUST have a parent or guardian sign the Service Order Form.
Lying about whether or not you are at least 18 years of age on the Service
Order Form will be grounds for account dismissal.
Account Usage
Crestar Communications' dialup accounts are single-user accounts. This
means that only one login from your account is allowed at a time, and the
owner of the account (or their immediate family) is the only person allowed
to use that account.
Our dialup accounts are unlimited access, reasonable use accounts. This
means that they are *not* dedicated lines, and customers should not leave
their systems dialed in, online and unattended. Users who find themselves
online for extended periods of time (8-10 hours per session) should contact
our Sales department about obtaining a dedicated line connection. Users
with three or more 10 hour sessions will be contacted and asked to curtail
their usage, as this is a violation of our acceptable use policy Also note,
the subscriber is responsible for telco charges on their own phone line. Crestar Communications is, and cannot be responsible for any long distance charges that may or may not occur. A list of local access numbers is available on this site or from any of our representatives at the office.
In addition to our usage policies, we also have rules prohibiting the
sending of unsolicited e-mails ("spamming") from a Crestar Communications
user account. Violation of the usage policies or rules may result in the
termination of your Crestar Communications user account.
From time to time circumstances occur that
adversely effect our ability to deliver an Internet connection to our
subscribers. This is the nature of connectivity and no provider is exempt
from occational outages and other related problems in providing sustained
service to its customers. We make every attempt to put in place the finest
equipment available on the marketplace and monitor and maintain this
equipment and telecommunications facility 24 hours a day, 7 days per week.
We have no control over upline providers or local loop providers, nor the
quality of their service. In this "house of cards", otherwise called a
network, when something goes wrong with one of our upline or local
providers, we can do nothing about it but put as much pressure on the
responsible party to correct the problem as quickly as possible.
Therefore, it is our policy that there will be no refunds or credits for
outages or other lesser problems that may crop up due to the nature of the
Internet and its wide spread issues of connectivity, including but not limited to, acts of God or any other causes of service failure that may present itself.
Billing and Settlement
Payment is Net 10. If you are paying by
by check or money order, it is your responsibility to get payment to
us on time. Unless your account is suspended by request, payment is
due and payable no later than the 15th of each month. If for
some reason you do not receive a statement and are not a
direct debit customer, you are still responsible for paying
your bill on time. Claims that no statement was received will
not be justification for non-payment, nor will such claim constitute a
waiver of late fees incurred. Failure to pay any and all monies, including
late fees, within the prescribed pay period as set forth herein, is
cause for account suspension and will be determined at the sole
discretion of Crestar Communications. If you wish to cancel your
account, you must give written notice (either mailed, faxed, or hand
delivered to us) 10 days pripr to the account renewal date, or you will
be charged for the next month and/or any subsequent months that go
without such notice. If for any reason your account is terminated,
any balance owing is expected to be paid in full. In the event that you
decide to terminate your account and fail to notify Crestar
Communications via the methods as prescribed above, then you will
be responsible for all charges that accrue to your account whether
you are using your Internet connection or not. If you prepay six or twelve
months and choose to cancel your account, you will be refunded for the unused
portion prorated to the end of the current thirty day cycle, charged
at the full rate, minus an exit fee of two months for six month prepayment,
and three months for twelve month prepayment. Refunds will take up to 6
weeks to process.
Receipt by Crestar Communications of customer information (checks or
cancellations) is determined by the date the information was physically
received at our office, and not by postmark dates, fax confirmation pages
or headers, etc.
Crestar Communications is not responsible for any long distance charges a
customer may accrue while using our service.
Indemnify and Hold Harmless
You are responsible for all actions that occur in regards to your account.
As a condition of service, you agree to indemnify and hold harmless Crestar
Communications its officers, employees, agents, and shareholders, for
any cause of action out of your account with use or your use of the
service.
Termination of Service
Crestar Communications, reserves the right to terminate or refuse service
to anyone, at any time, for any reason. The policies contained within may
change at any time without notice. It is the customer's responsibility to
keep abreast of our "Acceptable Use Policy" found here.
By logging on to your account you agree to the
terms and condition of use.
